Buyer and Seller agree to the following conditions of sale.
If, during the course of this puppy's life, Buyer cannot or does not wish to maintain proper care of this puppy, Seller has first right of refusal and/or will help place this puppy in an appropriate home.
This puppy will NEVER be relinquished to an animal shelter. If a suitable home cannot be found for this puppy, Seller will take the puppy in and care for it.
Deposits are non-refundable, except in the event the puppy should die while in the care of the Seller. In this event, Buyer may have choice of another puppy of equal purchase price, or may choose to have the deposit refunded, minus any PayPal fees.
Seller represents that this puppy has no known disease or life-threatening congenital defects at the time of delivery or pickup. Buyer must have this puppy examined by a qualified, licensed veterinarian within 2 business days of pickup or shipping date.
Should two unassociated veterinarians diagnose this puppy with a disease or life-threatening congenital defect, Buyer must provide a written statement from BOTH vets, including the vet's name, address and phone number. Seller will pay 50% of actual and documented vet costs – up to $200 in the event of the puppy's recovery. In the event of the puppy's death, Buyer must provide Seller with results from an autopsy conducted by a licensed veterinarian. Buyer may choose another puppy of equal purchase price when availability allows. Seller will pay shipping costs for the second puppy. Shipping of the second puppy will be scheduled by the Seller.
Seller warranties this puppy against life-threatening hereditary disorders for 1 year from the date of birth. A life-threatening hereditary disorder is defined as follows: Any disorder known to be of genetic origin from which this puppy will succumb prematurely, or which will require a lifetime of continuous medical care and unreasonable expense. Should two unassociated veterinarians diagnose this puppy with a condition as defined above, Buyer must provide written statements from BOTH vets – including the vet's name, address and phone number – detailing the condition. In the event of the puppy's death, Buyer must provide Seller with results from an autopsy conducted by a licensed veterinarian. If the above conditions are met, Buyer may choose a puppy of equal purchase price when availability allows. Seller will pay shipping costs for the second puppy. Shipping of the second puppy will be scheduled by the Seller.
Moleras, soft spots, reverse sneezing, or open fontanels are NOT life-threatening conditions.
Buyer understands that no monetary refunds are offered for this puppy, except those which are stated in this document.
Buyer agrees to maintain appropriate care for any diagnosed condition, as prescribed by a veterinarian.
Buyer understands, should this puppy develop a condition that is found by two unassociated veterinarians to be from neglect or abuse, all warranties in this document will be voided and Seller will require immediate return of the puppy with no further obligation on the part of the Seller. Failure to return this puppy to the Seller may result in the notification of the proper local authorities.
Seller is not responsible for costs associated with this puppy, including but not limited to shipping costs, supplies, and veterinarian care, except as stated in this document. Any reimbursement of medical costs associated with disease or congenital defect diagnosed within 2 business days of pick up or shipping is considered at the sole discretion of the Seller.
Seller cannot, and does not, guarantee size, breeding ability, show quality or temperament of this puppy at adulthood.
Seller does not warranty against hypoglycemia. It is the Buyer's responsibility to research and understand the nature, cause, and prevention of this condition. A veterinarian should be consulted in the event that symptoms of hypoglycemia appear.
Seller does not warranty against parasites, including but not limited to worms and protozoa. This puppy has received worming treatments and has displayed no symptoms of protozoa infection or has been successfully treated for such.
Buyer agrees to complete this puppy's vaccination series. Buyer further agrees to maintain all yearly health examinations and vaccinations as prescribed by a licensed veterinarian.
Buyer understands that Chihuahuas need extra care and attention. This puppy is not to be left outdoors for long periods of time, nor "chained out" or otherwise confined to any structure by means of rope, chain, cord or any other device, and left unattended.
Buyer agrees to read all information provided by Seller and follow all veterinary advice.
Buyer agrees to return one signed and dated copy of this contract to Seller at the time of delivery (or before if the puppy is being shipped). Should Buyer fail to do so, this puppy may be held beyond the original shipping date, at an extra expense to Buyer, until the contract is received.
Seller is not responsible for injuries to the puppy while in the care of the Buyer. Safe conditions must be maintained for the puppy at all times. This includes monitoring children and other pets while in the presence of the puppy.
Seller is in no way responsible for accidents during shipping, including but not limited to injury and loss. Seller will furnish shipping insurance for the puppy at the time of shipping. Any disputes regarding shipping must be worked out between the Buyer and the shipper. Seller will provide all relevant information to Buyer regarding shipment.
Seller will accept payments made on this puppy. Once a shipping date is set, Buyer will be responsible for making the final payment, including all shipping fees (if any), 10 days before the set shipping date; or, if the Buyer is picking up the puppy, the final payment must be made on or before the date the puppy is collected.
Cheques must be received 10 days prior to the selling date. PayPal must clear 5 days prior to selling date.
Buyer understands that failure to meet any condition of this document may result in the voiding of all warranties stated herein.
